What Is Third Degree Assault - Of all the three assault crimes in Colorado, Assault in the Third Degree, C.R.S. 18-3-204, is most commonly accepted in Fort Collins, Loveland and Estes Park. This frequency occurs because no evidence of physical harm is required and the police feel they have to charge something in response to a fight or dispute.
The elements of this crime include: knowingly or recklessly causing bodily harm to another person or being criminally negligent with a deadly weapon causing bodily harm. "Body injury" occurs when the victim is in pain. That's an easy threshold to meet, and that's why this crime is the most common assault in Colorado. A third-party attack can also occur when a person exposes a government emergency worker to liquids or hazardous materials. On the one hand, these elements are central to the evaluation of any case because they represent what the government must prove to a jury in order to convict a citizen of that crime.
What Is Third Degree Assault
If a person is injured by the intentional use of a deadly weapon, such as a knife or gun, or if someone is seriously injured, the charges are first-degree assault or second-degree assault. These crimes can result in prosecution to the Colorado Department of Corrections.
Child Molestation Third Degree
Unless a weapon is involved or a serious injury is involved, fights between people usually result in charges of third degree assault, a class misdemeanor. As a felony, this offense is punishable by up to twenty-four months in the Larimer County Jail or up to five years on probation. In some cases, the judge will give up to sixty days in jail as a condition of probation.
Our attorneys often use self defense to defend men and women who have been charged by the Fort Collins Police, Loveland Police or Larimer County Sheriff. To make this protection most effective, do not discuss the matter with law enforcement. Many of our clients try unsuccessfully to persuade the police to file charges or make arrests, only to harm their interests in court. We are most successful when we can approach the issue without the client's concerns. District attorneys instructed police to try to get the defendants to give statements about what happened. With that goal in mind, officers and agents will approach a person at a crime scene and be genuinely interested in what they have to say. When they talked, the police arrested them. Often, people who speak are misquoted, and this misrepresentation is present in police reports and police court testimony.
Domestic violence can be added to any of the three assault charges. Minor pushing and shoving games between a boyfriend and girlfriend will be charged as third degree domestic violence. This DV crime enhancement is important because it can lead to the loss of firearms rights and the elimination of security in the United States. In the normal course of these cases, the woman called the police, and Larimer County officers then arrested the man for assault or domestic violence. The police tend to arrest the man in this case because 1) the woman called the police first and 2) because he is more attractive and appeals to the "savior" mentality of the police. In the case of Assault, it is difficult for a man to get a fair shake, especially if he has more injuries than a woman.
Alcohol fights between alcoholics often lead to violent charges. Because college residents at Colorado State University drink alcohol, assault charges are common. Alcohol consumption causes many attacks. It is always better to avoid drinking too much because people make bad decisions when they are drunk. Even people who are usually calm can get into trouble when they drink alcohol.

A U.S. Army sergeant who was filmed shooting a black man in his South Carolina neighborhood this week has been charged with third-degree assault, the Associated Press reports.
Assault And Battery 3rd Degree, South Carolina
Sergeant First Class Jonathan Pentland, 42, was arrested Wednesday and taken to Richland County Jail. It appears he has since posted bail.
On Monday, a woman posted a photo on Facebook of a heated fight between Pentland and a black man in her neighborhood outside of Columbia, South Carolina.
Pentland was seen shouting at the man, getting in his face and telling him to get out of the area.
"You either leave or I'm going to move... from here," Pentland said in the video.

It's unclear from the video what sparked the fight, but at the end of the three-minute clip, Pentland's wife accuses the man of "getting into a fight" with one of their neighbors.
In the video, Pentland repeatedly asks what the man is doing in his neighborhood. The man said he was just walking and lived in the area.
When the man tried to reach Pentland's wife, Pentland pushed him, causing the man to nearly fall, the video shows.
The woman, Shirel Johnson, who posted the video on Facebook, wrote that she stayed with the man until the police arrived at the scene. He said an officer at the scene charged Pentland with malicious damage to property for dropping the man's cell phone on the ground, which happened after the video stopped.

Johnson said that he and his best friend were walking when they encountered the two men who were arguing, and he stopped to make sure the man was not injured.
"We came back to get him out of this situation because we refuse to see [him] go to jail or lie there dying because he's black," he wrote. "All you do is walk dark!!!"
In announcing Pentland's arrest Wednesday, Richland County Sheriff Leon Lott confirmed there were two other incidents with a black man that led to the fight, but said it "doesn't excuse" Pentland's behavior.
"There are other things that don't really justify [Pentland's] actions," Lott said. "None of them justified the attack that took place."
Fire Chief Convicted Of Third Degree Assault
"It's terrible, it's not important, it's a bad video. The young man is the victim, the one who was arrested is the perpetrator and he should be treated accordingly," he continued.
Lott added that the black man had "an underlying medical condition that may explain the nature of the alleged incidents."
Social media accounts linked to Pentland show he serves as a sergeant at the Fort Jackson garrison, the AP reported.
The installation's general manager condemned the video on Wednesday and said the Justice Department is looking into the matter.

"Fort Jackson commanders in no way condone the behavior shown in the recently released video," said Fort Jackson Commander Brig. Gen. Milford Beagle Jr., the statement said.
"I am deeply concerned for the members of our military family, for the young man and his family, and for the strain these actions add over time; please be patient as the facts are established."
Protesters gathered outside the Pentland family home on Thursday evening. The Pentland family had moved out of the home when protesters began vandalizing the home, the sheriff's department said.
